Terms and Conditions of Schubertiades

These Terms and Conditions ("Terms") govern the use of the Schubertiades platform ("Platform") by hosts, artists, and attendees. By using the Platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

1. Platform Overview

Schubertiades, Ltd is a company registered in the UK that operates a platform facilitating connections between artists and hosts for private, in-home events. The Platform, located at www.schubertiades.com, provides a ticketing system and promotes these private events to potential attendees.

2. Roles and Responsibilities

  • Hosts: Hosts are responsible for providing a suitable venue for the private event, ensuring the safety of attendees, and complying with all applicable laws and regulations. Hosts are solely responsible for any liabilities arising from hosting the private event.
  • Artists: Artists are responsible for performing at the agreed-upon time and location. They are responsible for the quality of their performance and providing any necessary equipment. Artists must comply with all applicable laws and regulations.
  • Attendees: Attendees are responsible for purchasing tickets to the private events and adhering to any rules or guidelines provided by the host. Attendees must conduct themselves in a respectful manner during the private event.

3. Ticket Sales and Revenue Sharing

Schubertiades, Ltd collects ticket payments on behalf of hosts and artists for private events. The ticket revenue is divided as follows:

  • Artists receive 41% of the ticket revenue.
  • Hosts receive 41% of the ticket revenue.
  • Schubertiades, Ltd retains 18% of the ticket revenue as a commission for its services.

4. Liability

Schubertiades, Ltd is not liable for any disputes, damages, or liabilities arising from private events hosted through the Platform. Hosts, artists, and attendees participate in private events at their own risk.

Hosts are solely responsible for any damages, injuries, or losses that occur during the private event. Hosts agree to indemnify and hold Schubertiades, Ltd harmless from any claims related to their private events.

5. Intellectual Property

Hosts and artists retain ownership of their respective intellectual property rights. By using the Platform, hosts and artists grant Schubertiades, Ltd a non-exclusive license to promote their private events and use any content (such as images) uploaded to the Platform for marketing and promotional purposes.

6. Termination

Schubertiades, Ltd reserves the right to terminate or suspend access to the Platform for any user who violates these Terms or engages in fraudulent or abusive behavior.

7. Refund Policy

Refunds may be requested by attendees under the following circumstances:

  • The private event is canceled by the host or artist.
  • The private event is rescheduled to a date and time that is not suitable for the attendee.
  • The attendee is unable to attend the private event due to unforeseen circumstances, such as illness or emergency.

Refund requests must be submitted by the attendee to Schubertiades via email (info@schubertiades.com) no less than 5 days before the scheduled start time of the private event. Refund requests made after this period will not be honored, except in cases where the private event is canceled by the host or artist.

Schubertiades reserves the right to withhold refunds in cases where it determines, in its sole discretion, that the refund request is fraudulent or abusive.

8. Modifications

Schubertiades, Ltd reserves the right to modify or update these Terms at any time. Hosts, artists, and attendees are responsible for regularly reviewing these Terms for changes.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in the United Kingdom.
