Terms and Conditions

The following Terms and Conditions govern the use of the Schubertiades platform and are binding for all users, including hosts, artists, and attendees. By accessing or using the platform, you agree to comply with these Terms. Failure to do so may result in suspension or termination of your account.

1. General Description of the Platform

Schubertiades, Ltd, a company incorporated under the laws of the United Kingdom, operates an online platform that connects musicians and hosts to facilitate concert experiences. Schubertiades acts solely as a technical intermediary, enabling smooth interactions between the parties involved, without assuming the role of a direct provider of the services offered at the events. All sales are direct transactions between hosts, artists, and attendees, facilitated by the platform.

2. Roles and Responsibilities

Hosts: Hosts bear sole responsibility for ensuring that the venue provided for the event complies with all applicable local laws, regulations, and safety standards, including but not limited to obtaining any necessary permits or approvals. Schubertiades disclaims any liability for legal infractions, penalties, or damages arising from the host’s failure to comply with such obligations.
Tax Obligations: Hosts are fully responsible for ensuring compliance with all applicable tax regulations in their respective countries regarding the income earned through Schubertiades. This includes, but is not limited to, declaring their income, applying the correct tax rates (such as VAT), and issuing invoices if required under local laws. Schubertiades will issue invoices for the 9% service fee it retains from host revenues.

Artists: Artists are obligated to perform as agreed upon, ensuring the timely arrival at the designated venue and maintaining the expected quality of their performance. They must adhere to all applicable legal and regulatory requirements, including copyright compliance where relevant.
Tax Obligations: Artists are fully responsible for managing their tax obligations regarding the income earned through Schubertiades. This includes declaring income, applying any applicable tax rates (such as VAT), and issuing invoices in compliance with the tax regulations in their respective countries. Schubertiades will issue invoices for the 9% service fee it retains from artist revenues.

Attendees: Attendees are responsible for purchasing tickets through the platform and for adhering to the rules and guidelines established by the host. Disruptive or inappropriate behavior during the event may result in removal from the premises, without entitlement to a refund.

3. Ticket Sales and Revenue Distribution

Schubertiades facilitates ticket sales for events organized through the platform. Revenue from ticket sales is distributed as follows:

Artists: 41% of net ticket revenue.
Hosts: 41% of net ticket revenue.
Schubertiades: Retains 18% of gross ticket revenue as a service fee, split as 9% from the artist’s share and 9% from the host’s share.

Schubertiades operates a centralized billing system. All payments from attendees are processed through Schubertiades, which issues receipts to attendees and invoices for its service fee to hosts and artists. Hosts and artists are responsible for ensuring compliance with their respective tax obligations in their jurisdictions, and Schubertiades assumes no liability for such compliance.

4. Limitation of Liability

Schubertiades acts solely as an intermediary and is not involved in the organization, management, or execution of events. Consequently, the platform is not liable for any disputes, damages, injuries, or losses arising during concerts. The host and artist agree to indemnify and hold Schubertiades harmless from any claims, liabilities, or legal proceedings associated with the event.

5. Intellectual Property

All intellectual property rights in the content provided by users (e.g., photographs, videos, or descriptions) remain the property of their respective owners. By using the platform, users grant Schubertiades a non-exclusive, royalty-free license to use such content for promotional and marketing purposes.

6. Termination

Schubertiades reserves the right to terminate or suspend any user’s access to the platform in the event of a breach of these Terms and Conditions or any fraudulent, unlawful, or abusive behavior.

7. Refund Policy

All ticket sales are final and non-refundable unless the event is canceled or materially altered. Any such refund requests must be submitted in accordance with the platform’s policies, and Schubertiades reserves the right to determine eligibility for refunds on a case-by-case basis.

8. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
