Terms and Conditions



The following Terms and Conditions govern the use of the Schubertiades platform and are binding for all users, including hosts, artists, and attendees. By accessing or using the platform, you agree to comply with these Terms. Failure to do so may result in suspension or termination of your account.



1. General Description of the Platform

Schubertiades, Ltd, a company incorporated under the laws of the United Kingdom, operates an online platform that connects musicians and hosts to facilitate concert experiences. Schubertiades serves as a payment service provider that enables financial transactions between musicians and hosts while also offering a technical platform to assist with event organization. Schubertiades does not act as a direct provider of event services nor does it assume any responsibility for the execution of the events.

All payments related to venue rental fees and ticket sales are processed through Schubertiades, ensuring secure transactions between the involved parties. The platform retains a service fee for its mediation services. However, all financial responsibilities, contractual obligations, and legal liabilities remain with the hosts and musicians. Schubertiades does not assume any liability for tax obligations, permit requirements, or legal compliance issues arising from any transactions facilitated through its platform.

2. Roles and Responsibilities

Hosts:

  • Hosts are solely responsible for ensuring that the venue provided for the event complies with all applicable laws, regulations, and safety requirements, including securing any necessary permits or approvals.
  • Contractual Relationship with the Artist: The host and the artist enter into a direct and binding contractual agreement regarding the use of the venue. Schubertiades is not a party to this contract and only facilitates the payment process.
  • Tax Obligations: Hosts are responsible for fulfilling any tax obligations related to income earned through Schubertiades. Hosts must issue an invoice to the artist for the venue rental fee if requested by the artist. The invoice must comply with any applicable tax and accounting regulations

Artists:

  • Artists are responsible for paying the agreed-upon venue rental fee through Schubertiades in advance of the event.
  • Revenue and Tax Obligations: Artists receive the revenue generated from ticket sales after platform fees are deducted. Artists are solely responsible for any tax obligations related to their earnings.
  • Ticket Sales: Artists act as the legal sellers of tickets to attendees. They must comply with all applicable tax and legal requirements regarding ticket sales. Artists must issue an invoice to the attendees for ticket sales if requested by the attendees. The invoice must comply with any applicable tax and accounting regulations.

Schubertiades:

  • Schubertiades acts solely as a payment service provider and a technical intermediary between hosts and artists. It does not participate in the contractual relationship between these parties.
  • Schubertiades is responsible for securely processing payments from artists to hosts and from attendees to artists, retaining applicable service fees.
  • Schubertiades issues invoices for the service fees it retains: 18% from host venue rental payments and 6% from artist ticket sales.
  • Schubertiades does not guarantee the execution, quality, or legality of any event organized through its platform. Any disputes regarding events must be resolved directly between the involved parties.
  • Schubertiades reserves the right to suspend or terminate accounts in case of fraud, misuse of the platform, or non-compliance with these Terms and Conditions.

3. Revenue Model and Payment Distribution

Schubertiades facilitates financial transactions in the following manner:

  • Hosts: Set a fixed venue rental fee per concert, which is paid in advance by the artist. Schubertiades deducts an 18% service fee from this payment.
  • Artists: Receive ticket revenue, from which Schubertiades deducts a 6% platform service fee.

4. Contract Between Host and Artist

  • By confirming a concert through Schubertiades, both the host and the artist agree to enter into a binding contractual agreement for the use of the venue.
  • Schubertiades is not a party to this agreement and solely acts as an intermediary to process payments.
  • The artist is required to pay the rental fee upfront to confirm the venue booking.

5. Venue Cancellation Policy

  • Flexible: A full refund (except comissions) will be issued if the musician cancels at least 3 days before the event.
  • Moderate: A full refund (except comissions) will be issued if the musician cancels at least 7 days before the event.
  • Strict: A full refund (except comissions) will be issued if the musician cancels at least 30 days before the event.

6. Limitation of Liability

Schubertiades solely acts as an intermediary and is not responsible for the planning, organization, or execution of events. Under no circumstances shall Schubertiades be held liable for any damages, injuries, financial losses, or legal disputes arising from concerts hosted and performed through its platform.

7. Intellectual Property

All intellectual property rights related to user-generated content, including but not limited to photographs, videos, and event descriptions, remain the property of their respective owners. By using the platform, users grant Schubertiades a non-exclusive, royalty-free license to use such content for promotional and marketing purposes. This license allows Schubertiades to reproduce, distribute, display, and create derivative works from the content in any media format for the purpose of advertising, marketing, and promoting the platform and its services. Users acknowledge and agree that Schubertiades has the right, but not the obligation, to use such content without further approval or compensation.

8. Termination

Schubertiades reserves the right to suspend or terminate user access to the platform in the event of any breach of these Terms and Conditions, fraudulent activity, or other misuse of the platform.

9. Refund Policy

All ticket sales are final and non-refundable unless the event is canceled or materially altered. Refund eligibility shall be determined at the sole discretion of Schubertiades based on the applicable platform policies.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom. Any legal disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
